On April 24, 2025, the Royal Gazette published the Ministerial Regulations Prescribing Overtime Payment and Compensation for Working Beyond Eight Hours Per Day for Security Work on Premises or Properties B.E. 2568 (2025). These regulations will come into effect 365 days from the publication date – i.e., in April 2026
Key Prevision
Previously, security guard work was excluded from standard overtime entitlements under the Labour Protection Act. They were only eligible to receive their regular wage rate for any overtime worked, whether on normal workdays or holidays.
With the newly issued Ministerial Regulations, security guard work beyond the regular 8 hours per day will now be entitled to the overtime payment.
It is worth noting that the applicable rates are different than those overtime payment rates provided in Section 61 and 63 of the Labour Protection Act.
Overtime Payment Rates for Security Guard Work
Security guard employees are now entitled to:
- Overtime on working days: At least 1.25 times the regular hourly wage for hours worked beyond eight hours per day.
- Overtime on holidays: At least 2.5 times the regular hourly wage for hours worked beyond eight hours on holidays (weekly holidays and public holidays).
In the case where the employer and employee agree to working hours exceeding 8 hours per day, the law prohibits that it must not exceed 48 hours per week, and any hours beyond 8 hours must still be compensated at the same applicable overtime rate stated above.
Working on Holidays - within 8 hours
While the Ministerial Regulations specifically address the overtime work on holidays, it is not mentioned about the regular working hours on holidays. Therefore, Section 62 of the Labour Protection will apply:
- For monthly-paid employees: Additional payment of 1 time of the regular hourly wage (i.e., a total of 2 times the hourly wage) for the hours worked on holidays.
- For daily-paid employees: Payment of at least 2 times the regular hourly wage for hours worked on holidays.
Purpose and Impact
This regulatory change aims to better align protections for security guard employees with current labour standards and economic conditions. It eliminates previous exemptions that allow employers to avoid overtime obligations for security guard employees and ensures that such employees receive fair compensation for extended work hours.
This change is expected to impact on businesses that directly employ security guards, as well as security service providers. Outsourcing companies may adjust their service fees to accommodate the new legal requirements.
